These Terms and Conditions govern your use of the tescocontractmobilephones.com website (Tesco Contract Phones Site) and your relationship with Tesco Stores Limited trading as Tesco Telecoms (Tesco, we or us).

Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Tesco Contract Phones Site.

1. Use of the Tesco Contract Phones Site

The Tesco Contract Phones Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Tesco Contract Phones Site you agree to be bound by these Terms and Conditions.

These Terms and Conditions govern your use of the Tesco Contract Phones Site and online store and all services provided in connection with these.

All orders and purchases made on the Tesco Contract Phones Site will also be governed by the specific Product Terms & Conditions (Product Terms) relevant to the online store - please click here to see these. References to the Terms and Conditions include the relevant Product Terms.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

2. Amendments

We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the online store. Any changes will be notified to you via a suitable announcement on the Tesco Contract Phones Site. The changes will apply to the use of the Tesco Contract Phones Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Tesco Contract Phones Site and the online store.

3. Clubcard, vouchers and coupons

This paragraph on Clubcard is in addition to the terms and conditions of Tesco Clubcard.

To be awarded Clubcard points applicable to purchases on the Tesco Contract Phones Site you need to have a valid Tesco Clubcard or a Tesco e-Clubcard number that you must enter when requested on the Tesco Contract Phones Site.

Provided that the relevant purchased items have not been returned the points will be added to your Clubcard as follows:

  • For Contract phones, after your phone has been active for more than three months and thereafter monthly to the end of your contract period.
  • For Laptop/Broadband, after your broadband had been active for more than three months and thereafter monthly to the end of your contract period.
  • For all promotional points exclusive to sales over the Internet, after your phone has been active for more than three months.

Clubcard points received for the purchase of a refunded item may be removed from your Clubcard account.

The following items cannot be redeemed against purchases on the Tesco Contract Phones site: (a) paper Clubcard Vouchers, electronic Clubcard eVouchers (which are issued for use on Tesco.com), (b) bonus coupons (which may be received with the quarterly Clubcard mailing, by email, awarded online or handed out in a Tesco retail store), and (iii) product or discount coupons issued by manufacturers or promoters.

4. Cashback

Cashback is only available on certain contracts and is subject to a minimum period of line rental. Tesco will automatically credit cashback (on applicable contracts) to the bank account/credit card used to pay your monthly tariff. Payments are made after you have paid your third monthly bill in full. If you change your bank account/credit card please call customer care on 0800 015 2006, so that we can adjust our records and make payment to you.

You will receive the cash back to the card you used to place the order and not a cheque.

5. Tesco Telecoms eCoupons

Tesco Telecoms may issue its own eCoupons directly or via Tesco channels or third parties.

This section sets out the terms and conditions for Tesco Telecoms eCoupons. Tesco Telecoms eCoupons are redeemable at the checkout page when making a purchase from the Tesco Telecoms Site. eCoupons can only be used on the Tesco Telecoms Site and are not redeemable on Tesco.com, through Tesco Stores Limited or Tesco Personal Finance.

We are entitled to cancel and reissue any eCoupons for any reason. We are entitled to suspend or change any aspects of the operation of eCoupons at any time.

A. Using eCoupons

An eCoupon can only be used either as part payment for the item(s) stated on the eCoupon or in conjunction with the minimum spend threshold stated on the coupon in a single transaction.

If we reasonably believe that there is a breach of security or fraudulent use of eCoupons, we may reject any eCoupon.

Once you have used an eCoupon once, you cannot use it again. eCoupons may require a valid associated Clubcard number or email address to be given.

B. Restrictions on using eCoupons

You cannot use an eCoupon against the delivery charge or the postage & packaging of an order. Unless we tell you otherwise on the eCoupon, eCoupons cannot be used in conjunction with other offers.

eCoupons cannot be exchanged for cash or gift vouchers.

6. Refunds on promotional offers

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price paid. Your statutory rights are not affected.

7. Excluded services

The services provided by the Tesco Contract Phones Site do not include the provision of computer or other necessary equipment to access the Tesco Contract Phones Site. To use the Tesco Contract Phones Site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

8. Intellectual property

The content of the Tesco Contract Phones Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Tesco Contract Phones Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Tesco contract phones site without written permission from Tesco Telecoms.

No licence is granted to you in these Terms and Conditions to use any trade mark of Tesco or its affiliated companies including, without limitation, the trade marks TESCO, Tesco Telecoms and TESCO CLUBCARD.

9. Your use of the Tesco Contract Phones Site

You may not use the Tesco Contract Phones Site for any of the following purposes:

  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
  • transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
  • gaining unauthorised access to other computer systems
  • interfering with any other person's use or enjoyment of the Tesco Contract Phones Site
  • breaching any laws concerning the use of public telecommunications networks
  • interfering or disrupting networks or web sites connected to the Tesco contract phones site
  • making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner

You will be responsible for our losses and costs resulting from your breach of this section 8.

Tesco Telecoms reserves the right to refuse to post material on the Tesco Contract Phones Site or to remove material already posted on the Tesco Contract Phones Site.

10. Availability of the Tesco contract phones site

Although Tesco Telecoms aims to offer you the best service possible, Tesco Telecoms makes no promise that the services at the Tesco Contract Phones Site will meet your requirements. Tesco Telecoms cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to customer.service@tescocontractmobilephones.com and we will attempt to correct the fault as soon as we reasonably can.

Your access to the Tesco Contract Phones Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Tesco Telecoms will attempt to restore the service as soon as it reasonably can.

11. Tesco Telecoms' liability

If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result and to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order.

Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

This section 10 shall not limit or affect our liability resulting from any products sold through the Tesco Telecoms Site being found to be unsafe or if something we do negligently causes death or personal injury.

The Tesco Telecoms Site provides content from other Internet sites or resources and while Tesco Telecoms tries to ensure that material included on the Tesco Contract Phones Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If Tesco Telecoms is informed of any inaccuracies in the material on the Tesco Contract Phones Site we will attempt to correct the inaccuracies as soon as we reasonably can.

12. Third party websites

As a convenience to Tesco Telecoms customers, the Tesco Contract Phones Site includes links to other websites or material which are beyond its control. Tesco Telecoms is not responsible for content on the Internet or World Wide Web pages on any site outside the Tesco Contract Phones Site.

13. Advertising and Sponsorship

Part of the Tesco Contract Phones Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Tesco Contract Phones Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

14. Applicable law

We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with you in any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

15. International use

Tesco Telecoms makes no promise that materials on the Tesco Contract Phones Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Tesco Contract Phones Site from territories where its contents are illegal is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

16. Expiry date on payment card

Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.

17. Miscellaneous

You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

If you breach these Terms and Conditions and Tesco Telecoms chooses to ignore this, Tesco Telecoms will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

Tesco Telecoms shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.

18. Instant Gifts for Contract Mobile Terms and Conditions

1. Your gift will be posted to you together with your handset.

2. Your handset and gift will be delivered by DPD which you will have to sign for.

3. For orders placed before 12 noon we aim to deliver your order the next day (except for weekends and bank holidays). We aim to deliver orders placed after 12 noon within two working days.

4. Whilst we will make every effort to ensure that the free gift offered is provided to you by the date agreed, all free gifts are offered subject to availability at the time of delivery.

5. In the event of a gift being unavailable for unforeseen reasons, we reserve the right to substitute your gift for an alternative of equivalent or greater value. In some cases a substitute may not be possible, e.g. Nintendo Wii and in which case the free gift will be provided as soon as we receive new stock.

6. Wherever possible we will ensure you are provided with a substitute gift of the same type. For example, a HP Laptop may be replaced by an equivalent product made by Sony.

7. Free Gift images are for illustration purposes only and colours may vary (e.g a Sony PSP may be supplied in either black or white).

8. Free Gifts are limited to two per household per year.

9. We are able to deliver gifts to England, Wales, Scotland and Northern Ireland only.

10. While we make every effort to post your gift to you within the times set out at paragraph 2 and, where possible before Christmas, we will not be responsible if we fail to do so due to circumstances beyond our control.

11. If you are unavailable when DPD tries to deliver your gift, you will need to call them to re-arrange delivery. We will not be responsible if you miss the delivery.

12. If you have a query with your gift, you must notify us on 0800 015 2006 within 48 hours of delivery

13. This offer is non-transferable.

14. We reserve the right, where we consider there to have been any breach of these Terms and Conditions or any fraud or abuse of this promotion to seek reimbursement of any gift awarded.

15. If you change your mind and cancel your contract under our cancellation policy you must also return your free gift in its original and undamaged packaging with all of its components and we reserve the right to seek recovery of the gift and make a charge for the cost of recovery or invoice you for the product.

16. We recommend that you keep a copy of this certificate for your records.
