Please read these Product Terms and Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco Telecoms makes the products available to you via the tescocontractmobilephones.com website (Tesco Contract Phones Site).

Mobile phone and Laptop/Broadband purchases are also subject to the terms and conditions of the applicable network provider. Please see Network Terms and Conditions for these.

1. Prices and product information

The prices payable for the items that you order are clearly set out on the Tesco Contract Phones Site.

Every effort is made to ensure that prices shown on the Tesco Contract Phones Site are correct. If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item concerned. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price.

All prices are expressed inclusive of any VAT payable unless otherwise stated.

The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed in the 'Help' section of the Tesco Contact Phones Site.

Product information is included on the Tesco Contract Phones Site and if there is anything which you do not understand, or if you want information, please see our jargon buster and buyers’ guide.

2. Bulk buy policy

To ensure availability of all our mobile phones and Laptop/Broadband, customers for Contract phones are limited to a maximum of two per order.

3. Availability

Only items which are in stock will be shown on the Tesco Telecoms Site. If for any reason beyond our reasonable control, we are unable to supply a particular item we will not be liable to you except to ensure that you are not charged for that item.

4. Acceptance

Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch the goods to you, at which point a contract will be made between us. At any point up until then you may cancel your order or we may decline to supply the goods to you. Acceptance of the offer and despatch of Contract phones is subject to your successful completion of a credit check.

By placing an order you are authorising us to accept signature from another person on your behalf if you are not present at the time of delivery.

Where items are despatched separately, then our acceptance of the order in respect of each item takes place when that item is despatched, and you will be charged for each item when it is despatched.

5. Delivery

Delivery will be made to the address specified by you on the completed order form.

We are able to deliver Contract phones and Laptop/Broadband to England, Wales, Scotland and Northern Ireland. We can deliver other products to England, Wales and Scotland only.

Your order will be delivered by DPD which you will have to sign for. If you are unavailable when they call DPD will leave a card, and you will need to call them to re-arrange the delivery.

Whilst we make every effort to deliver all your goods within 28 days of the date of your order, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

For orders placed before 12 noon we aim to deliver your order the next day (except for weekends and bank holidays) and in any event we aim to deliver within 3 to 7 working days. As stated above, despatch of Contract phones and Laptop broadband is subject to successful completion of a credit check and this may delay despatch and delivery of your order.

Some items will be delivered direct from the manufacturer who will contact you to arrange delivery.

Please note that once the delivery of the items has been arranged directly with the manufacturer, you will be subject to the manufacturer's delivery policy.

Ownership of the item(s) will not pass to you until such time as we have received payment of the purchase price in full. Risk of damage to or loss of the item shall pass to you at the time of delivery of the item(s).

6. Cashback and Gifts

Cashback and Gifts are only available on certain contracts and are subject to a minimum period of line rental. Details of how to claim Cashback and Gifts will be set out in the Cashback and Gift Certificate which will be provided to you when you sign up for a Tesco Contract Phone. In order to claim your Cashback or Gift you will be required to produce two forms of identification. The Cashback and Gift Certificate will list the forms of identification which are accepted.

Cashback/gifts/promotional items that are given away in conjunction with a purchase may be despatched to you separately and delivery times may vary.

If you change your mind and return your item under the returns policy in section 8 below you must also return any free gift/cashback/promotional item received by you as a result of that order. Free gifts/cashback/promotional items are subject to availability and terms & conditions as set out on the Tesco Contract Phones Site and in the Cashback and Gift Certificate.

7. Cancellation

You have the right to cancel your order for Contract phones and Laptop broadband at any time after you place it up to 14 days from receiving delivery of the item

If the item has not been dispatched we will cancel the order and we will not take payment from your card.

If the item has been dispatched you can refuse to sign for the delivery so that the goods are returned to us and we will refund the price paid to your card; alternatively if you have taken delivery please follow the procedure under ‘I’ve changed my mind and want to organise a return & refund’ in section 8 below.

8. Returns

We hope you are happy with your Tesco Telecoms order however if you should wish to return any item(s) you can do so as explained below.

(Please note you cannot return items ordered from the Tesco Contract Phones Site to Tesco retail stores.)

I've changed my mind and want to organise a return & refund

You can change your mind and tell us that you would like to return Contract phones you have 28 days to return the hardware within 14 days from the order date of the item.

  • To arrange the return of the item(s) please Contact Us.
  • Addressed return packaging will be provided by us, and you must then return the item(s) in their original condition, including any accessories, vouchers and free promotional items within the 28 days of your cancellation. When you return the item(s) please remember to quote the returns reference number we have given you. You will have to pay for returning the product to us but once we have received the returned item(s) in their original condition, this postage cost will be refunded to you by cheque.
  • Upon safe return to us of the item(s) in their original condition we will remit a full refund of the price paid back onto the original payment card. (Please note that Clubcard points will not be awarded for returned items.)
  • If you do not return the items within 14 days of your cancellation, we will make a charge in respect of the cost of recovering (or attempting to recover) the item(s).
  • If you do not return the item(s) after our reasonable attempts to recover them, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the Tesco Contract Phones Site.
  • For Laptop/Broadband, If you change your mind and cancel your contract under our cancellation policy you must also return your laptop in its original and undamaged packaging with all of its components and we reserve the right to seek recovery of the laptop and make a charge for the cost of recovery or invoice you for the product.

There's a fault with my phone, Laptop or Broadband dongle

  • Unless we tell you otherwise, all items on the Tesco Contract Phones Site are supplied with a 12 month manufacturer's warranty.
  • If an item develops a fault and you would like to return it to us you can do so within 14 days of receipt of the item (see below for what happens if the fault develops after 14 days)
  • If the item becomes faulty please Contact Us. For mobile phones & Laptop/Broadband: if the fault has occurred within 14 days of delivery we will arrange for a replacement or refund; if the fault has occurred after the initial 28 day period but within the 12 month warranty period, contact our customer care team to arrange for repair. For accessories: if the fault has occurred within the 12 month warranty period, we will arrange for a replacement or refund. In each case, if the fault is caused by accident, misuse, negligence or abuse of the item, it will not be covered by the manufacturers 12 month warranty and you will not be able to get a replacement or refund.

Nothing in these Product Terms shall affect your statutory rights relating to faulty goods or services provided. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.

9. Payments

You can pay by Tesco Clubcard plus, Mastercard or Visa credit card, Switch or Delta debit card. We do not currently accept Visa Electron or Solo cards.

Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure.

Authority for payment must be given at the time of order.

10. General

Except as expressly set out in these Product Terms, all use of your personal information will be made in accordance with our Privacy Policy.

We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

These Product Terms & Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.
